MISION LOS SAHUAROS (MS)
Convenants, Conditions and Restrictions (CC & R’s)
Your cooperation to comply with the Development CC&R's shall benefit all of the owners and residents therein. Their purpose is to ensure the peaceful living, the keeping of harmony and calm ideas as formerly conceived, and the increase of property values. In any case, staying is intended to be a peaceful living.
1. Only those owners appointed in Title Deeds and their guests shall be allowed to enter and stay in the property.
2. Property transfer is permitted, provided a written notice is given to MS at least 15 days in advance.
3. A Technical Committee for which MS is responsible shall watch, apply, and update these CC&R's in the first place. Once the Development is 70% sold out, these activities shall be performed by a Committee composed by the Landowners Association, as the Property Owners appointed in their Title Deeds.
4. Every construction performed shall have the prior written consent by the MS' Technical Committee.
5. One-story house exteriors shall not be higher than 16' (sixteen feet), and interior shall not be less than 10' (ten feet).
- Setbacks from property lines shall not be less than 3_' (three and a half feet) in every lot.
- Only a garage or entry porch is permitted to adjoin the front property line.
- Fences shall not be higher than 4' (four feet), exclusive of front fence, which shall not be higher than 3' (three feet).
6. No fire-arm shootings, bonfires, or anything tending to cause environment damage or pollution is permitted.
- Prohibited is drunkenness, violence, disturbance noise or loud music.
- No one under the age of 16 years old may drive a motorized vehicle on the property.
- All motorized vehicles will be driven no faster than 10 Mph on the property.
- ATV's will be driven on or off the property directly to their home at the registered speed limit. If violated will be required to push it on and off the property.
- In fact, nor shall anything be done tending to cause annoyance or nuisance to the community.
7. No lofty tanks, antennas, nor construction alterations shall be made without the prior written consent by the MS' Technical Committee.
8. Music, loud vehicles, must respect the quiet hours on the property.
9. Quiet hours are from 11pm to 9 am.
10. Owners may have as many family as required. Renters can have no more than 6 persons per house.
11. Owners cars must be parked in the garage or carport.
12. The water that comes from the well can only be used for domestic use, it can not be used for construction works, it is the responsibility of the owner of the property to provide the water for this matter.
13. Each House must have two container underground, one of them as water storage for home usage purposes and the other one to be used as the house septic tank.
14. All houses which shall always be approved by MS must be completed within one year from start of construction.
15. No park models or manufactured homes are allowed. Only homes that are approved by MS are permitted, which shall be always well maintained.
- No non-operational vehicles, appliances, or parts shall be placed on the roads. In such a case they must be stored in totally enclosed structures.
16. Every homeowner and person staying in MS is bound to comply with Mexican Regulating Laws. Violation of said laws and/or the CC&R's herein will construe a reason to annul the Title Deed and the rights thereof.
17. HOA's fees for lots are $300.00 dollars per year. This fee includes, but is not limited to: security, garbage removal, pools, roads, and common area maintenance.
18. The owner of each property at “Mision Los Sahuaros” who wants to sale the property by his/her own or hiring a real estate, will give the first option of buying to the members of the development “Mision Los Sahuaros” thru the Legal Representative of this development.
19. Every entitled owner stays in his/her property under his own responsibility and prevents the MS Administration from any action or claim whatsoever, arising from any damages including death, exclusive of those deliberated acts performed by MS Administration.
20. Every owner who rent or invite a person to stay at the development must be responsible that the people who rent or is invite it know and follow the CCR´S.
21. Only authorized guests registered by the OWNER will be allowed access to the development.
22. All guests and renters must register at the front office to receive registration cards to access the development.
23. Guests must park in provided guest parking.
24. All damages that may occur in the development by their guests and renters will be taken from the damage deposit or charged to the home owner.
25. Renters that do not respect the Development CC & R's will be given (one only) written citation from security and a repeat violation they will be asked to leave the development without a refund.
26. Only certain pets are allowed which do not alter Development's flora and fauna, nor disturb Neighbors' tranquility. No wild animals or dangerous reptiles shall be kept as pets.
27. No more than three animals will be allowed per house.
28. Every person inside the development must respect the Club house and Common areas rules.
29. Water rights shall not be transferred to landowners.
30. Any issues not provided for herein will be solved by the MS Technical Committee; thus making it possible to update the CC&R's to feet Development needs.
- Any amendments or additions hereto shall be notified to each and every Landowner at their address.
- The Administration is not responsible for the mail office mishandling or incorrect or not updated addresses.
31. The property owner shall give assurance; along with Mision Los Sahuaros that constructor will comply with the construction agreement.
32. The property owner shall follow and respect these and any other regulations that might be added hereto benefit everyone in the development.
